1. Terms and Conditions of Use

These terms and conditions of use (“Terms of Use” or “Terms”) are applicable to and govern the use of this website (the “Site”) and any of the hospitality services offered by Antrim Streamside, LLC (hereinafter, “Antrim Streamside LLC”, “us”, “we” or “our”), whether, accessed online, through any mobile device, by email or by telephone. By accessing, browsing, and using the Site through whatever platform and/or booking a reservation, communicating with us by email or telephone, you acknowledge and agree that you have read, understood, consent and shall be bound by these Terms, including the terms and conditions of any other policies to which the Terms link or refer.

IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE OR ARE OTHERWISE DISSATISFIED WITH THE SITE, PLEASE DO NOT ACCESS OR USE THE SITE.

We reserve the right to change these Terms of Use from time to time in our sole discretion without notice to you and any such changes will be effective upon publication on the Site. Please check this Site periodically for changes. Your continued access or use of the Site following any changes to the Terms of Use constitutes your acceptance of those changes.

We control and operate the Site from the United States. We do not represent that the materials on the Site are available for use in other locations nor do we represent that the Site will be fully functional in other locations. Persons who access or use the Site from other locations are responsible for compliance with any applicable local laws.

From time to time, the Site may not be accessible due to maintenance, upgrades, repairs, computer system and technological problems or other unforeseen circumstances. In addition, from time to time, information on the Site might contain typographical or visual errors, inaccuracies or omissions that may relate to the description of our accommodations, services, or the Property (as hereinafter defined) in general. It is your responsibility to monitor changes to the Site. Any reliance on the information on the Site is at your own risk. We may, but have no obligation to, correct any errors, inaccuracies or omissions, and to update and modify the Site Content (as hereinafter defined) at any time without prior notice.

Age Restriction: This site is for use of persons 18 years of age and older. If you are under 18, or not of legal age to form a binding agreement, you may not access or use the Site.

2. Scope and Nature of Our Hospitality Services

The following Terms, policies and rules relate to Antrim Streamside, located at 408/416 DeBruce Road, Livingston Manor, NY  12758, including all of its offices, accommodations and land (collectively, the “Property”).

Check In and Out Policy:  Check in time: 3 pm or later. Check out time: by 11 am. 

Booking and Cancellation Policy: By confirming your reservation, you are agreeing to our booking and cancellation policy. A 50% deposit for length of stay is required at booking. Payment in full is required two weeks prior to arrival. A full refund, less a $35 processing fee, is available if the reservation is cancelled two weeks or more prior to arrival. Cancellations made within two weeks of the arrival date will result in a cancellation fee, which is the full payment due on account of the reservation. No refunds will be provided to no show guests or guests who cancel within two weeks of the reservation date. 

Deposits made when booking for special events on the Property (a “Venue Booking”) vary based on the type of event. Generally, a 50% deposit for guest accommodation fees is required for a full Venue Booking and the balance will be due 6-8 weeks prior to the event. 

By completing a reservation with us you agree to receive written or electronic correspondence from us regarding your stay and inviting you to submit guest reviews or otherwise post on social media.

Reservation Policy:  We accept and book reservations based upon the availability of our accommodations. We reserve the right to refuse or reject a reservation in our sole discretion and for any reason, which may include but, not be limited to, unavailability of accommodations, a person’s prior acts in contravention of our Conditions of Guest Behavior on the Property or violation of any of these Terms, or the closing of the Property for a special event.

By making a reservation with us on the Site or any platform, by email or by telephone, you agree that we may share information about you and your transaction with other entities for various purposes, including, without limitation, to process your reservation, to collect on any unpaid debt and to obtain credit card authorization. Our information collection and use policies are set forth in the Site’s Privacy Policy (www.antrimstreamside.com/privacy-policy), which is incorporated herein by reference.

Pandemic Health Provisions: In response to the COVID-19 pandemic, we have implemented CDC and NY state and local cleaning and sanitizing protocols to reduce the risk of coronavirus infection. Nevertheless, the risk of exposure cannot be completely controlled. Accordingly, as a guest of Antrim Streamside, you acknowledge and certify that:

• You understand the risk of exposure to COVID-19 and other viruses, bacteria and other microorganisms that may cause illness, and that there is a risk in encountering contaminated objects and persons that could result in illness, permanent disability, or death.
• Within 14 days immediately preceding the date of your arrival, no one in your party has: (i) tested positive for the COVID-19 virus or has been identified as a potential carrier of the COVID-19 virus; (ii) experienced any symptoms commonly associated with COVID-19 infection; or (iii) has been in direct contact with, or in the immediate vicinity of, any person known to be carrying the COVID-19 virus or exhibiting symptoms commonly associated with COVID-19 infection.
• You agree to comply with social distancing protocols as articulated by the CDC and NY state officials.
• Antrim Streamside has the right to request any person who is not in compliance with any provisions of this section, or these Terms and Conditions generally, to leave the premises, without refund.
• You agree to notify Antrim Streamside in the event that anyone in your party is diagnosed with COVID-19 or exhibits symptoms within 14 days after your stay.
• You agree to release and hold harmless Antrim Streamside and its Protected Entities (as defined herein) from and against all claims for damages and liability resulting from exposure to COVID-19, any other viruses, bacteria and other disease causing microorganisms and contaminated objects, as well as personal contact with others while on the Property.

The Property and Maximum Occupancy: We currently have 6 (six) accommodations on approximately 250 acres, consisting of the River House, the Stone Cottage, Orchard’s Edge cabin, Pond View cabin, The Pines cabin and Meadow Vale.  Following are the guidelines with regard to the use of the Property’s cabins: (i) The maximum number of guests permitted in the Stone Cottage is limited to six (6) persons; the maximum number of guests permitted in the River House is eight (8) persons; the maximum number of guests permitted in each of the Meadow Vale and The Pines cabins is two (2) persons per cabin; the maximum number of guests permitted in Pond View cabin is four (4) persons; and the maximum number of guests permitted in Orchard’s Edge cabin is three (3) persons. Violations of the maximum occupancy set forth above will result in an additional charge of $100 per guest per night, and the guest may be required to leave immediately based upon our sole discretion without any refund owing for any remainder for the stay reserved.

Pets: Pets (“Pet Guests”) are permitted to stay at Antrim Streamside, but only in the Stone Cottage, and with our prior consent. Guests are permitted to bring up to two (2) Pet Guests. The fee for a Pet Guest is based upon the length of stay and type of pet, ranging from $50 - $75 per night per Pet Guest. Other than Pet Guests staying in the Stone Cottage, only service animals that meet the requirements of the Americans with Disabilities Act will be allowed to stay in our other accommodations. Pet Guests are not allowed on the furniture at any time and must be leashed at all times when taken outside and are on the Property, unless in the corral. Guests must clean up after their Pet Guests. If any Pet Guest is left alone in the Stone Cottage (or other accommodation if the Pet Guest is a service animal) it must be crated.  We do not provide crates; it is the owner’s responsibility to bring its own crate. All Pet Guests must be up to date on rabies vaccinations and all other vaccinations. Heart worm preventive is highly recommended. All canine or feline pets are to be treated with Advantage, Frontline, Bravecto or similar flea and tick repellent three (3) – five (5) days prior to arrival. Fleas and ticks are rampant in this area and can cause harmful/fatal illness to people and pets.  All obligations set forth above are the sole responsibility of the pet owner.  We reserve the right, in our sole discretion to request any Pet Guest that is disruptive, aggressive or whose owner does not comply with our policies to be removed from the Property. In such event, there will be no refunds. Guests are responsible to pay any and all costs that we incur for any damage or excessive cleaning needed after a stay with a Pet Guest. Failure to comply with any terms of this provision will result in additional fees that will be based upon our costs to rectify any damage that may have been caused by a Pet Guest. In addition, guests are responsible for any lost rental income due to damage caused by any Pet Guest. All fees will be charged directly to the card used for booking.

We assume no responsibility for any illness or injuries to (i) a Pet Guest that may occur during a stay; or (ii) any of our guests due to an act of Pet Guest while on the Property, including, but not limited to, any consequences of any Pet Guests being released in the corral and escaping therefrom, or any consequences due to a owner’s failure to comply with the provisions herein, including the requirement to maintain the Pet Guest on a leash when on the Property.

Smoking: We are a NON-SMOKING PROPERTY. Smoking is not permitted in any guest accommodation, on porches, decks, patios, or anywhere else on the Property.

Conditions of Guest Behavior on the Property: For the safety and enjoyment of the Property and all our guests, Antrim Streamside, LLC requires all guests to comply with the following conditions:

• No damage is done to the Property or its accommodations, beyond normal wear and tear.
• If a guest is found to be using, or otherwise in the possession of, contraband or any illegal substances, such guest is responsible for any and all liabilities (including, but not limited to, fines) that may arise in connection therewith. Further you acknowledge and agree that you will indemnify Antrim Streamside, LLC pursuant to the provisions of the Indemnification provisions set forth herein.
• All debris, rubbish, discards and recycling are placed in the appropriate trash/recycling receptacles provided. Soiled dishes should be cleaned, or at a minimum, placed in the sink.
• Accommodations are to be left locked when the guest has departed from the Property.
• All charges accrued during the stay must be paid prior to departure.
• No towels or linens are lost, damaged or removed from the Property. IF ANY TOWELS OR LINENS ARE REMOVED, A REASONABLE FEE WILL BE CHARGED TO THE GUEST’S CREDIT CARD, DEPENDING ON THE TOWELS OR LINENS REMOVED.
• No bath amenities or bathrobes are removed from the room. Custom bath amenities are provided in large, eco-friendly bottles. PLEASE NOTE THAT IF ANY BOTTLES OF ANY BATH AMENITIES ARE REMOVED, A $30 (PLUS TAX) FEE WILL BE CHARGED TO THE GUEST’S CREDIT CARD. IF ANY BATHROBES ARE REMOVED, A $75 FEE (PLUS TAX) PER ROBE WILL BE CHARGED TO THE GUEST’S CREDIT CARD.
• None of the reference books on activities in the Catskills, fly fishing or hiking are removed from the Property. PLEASE NOTE THAT IF ANY OF THESE BOOKS ARE MISSING UPON CHECK OUT, A $30 (PLUS TAX) FEE WILL BE CHARGED TO THE GUEST’S CREDIT CARD.
• Guests are requested to be mindful of other guests while playing music outdoors and engaging in any lawn games, fire pit gatherings, grilling or other outdoor activities.

Taxes:  Overnight rates and purchases are subject to applicable New York State and local taxes.

Rate Changes and Restrictions: Rates are subject to change without notice. Certain offers will carry restrictions on the reservations made, such as no opportunity to cancel or obtain a refund. It is the guest’s responsibility to check the conditions and any restrictions thoroughly on any special offers.

Massages/Yoga/Guided Excursions: We recommend that you schedule massage treatments, yoga classes and private instruction or excursions prior to arrival in order to better secure a time most convenient to you. Reservations are subject to availability and must be guaranteed by a credit card. Please note that these services are provided by third parties that are not in any way affiliated with Antrim Streamside, LLC. We make no representations or warranties as to the quality of these services and we are not responsible for the performance of these activities.

No Daily Housekeeping Services: Linens and bath towels are included in the rental rate; daily housekeeping service is not included in the rental rate. However, we will enter each accommodation approximately every 3 days to remove trash, refresh linens and towels and to perform a light cleaning.

We suggest that guests bring their own beach towels. We do not permit towels or linens to be taken from the accommodations.

Pest Control: The Property is presented to the guest in a clean and sanitary condition. However, due to the nature of the Property’s stone structures and its location in the countryside, it is necessary to treat the premises with mouse bait traps, placed in discrete locations in and around the buildings on the Property. Mouse bait traps are extremely hazardous and would cause injury or death to people and pets. Accordingly, we advise that children and Guest Pets be supervised at all times and kept away from bait stations. In addition, sections of the Property are sprayed with insecticides to protect against insect infestation. Guests are hereby advised of the possibility of illness or injury and agree to hold Antrim Streamside, LLC, and its owners, members, employees, agents and representatives harmless from any loss, damage or liability that may result from the presence of mouse bait traps or other pest control treatments.

Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental payment, and the party will not be permitted to check in.

Storm Policy/Drainage Conditions: No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive vehicles and/or chains during the winter months in the event of a storm or inclement weather conditions. We do not refund rental fees due to road conditions.

3. Intellectual Property

Our Proprietary Rights: Antrim Streamside, LLC owns, solely and exclusively, and retains all rights, title and interest (including, without limitation, copyrights) in and to the Site and the Site Content (as hereinafter defined). All Site Content and other materials displayed and available on this Site, including without limitation trademarks, service marks, trade names, logos, images, photographs, audio, visuals, text, illustrations, renderings, drawings, videos, software and the “look and feel”, design and organization of the Site (collectively, the “Site Content”) are protected by copyright, trademark and other intellectual property laws. Your use of the Site does not grant to you ownership or title in or to any Site Content or any other part of the Site, nor does it grant you any license to reproduce, republish, distribute, display, perform, transmit, sell or otherwise use any Site Content for any commercial purpose.

Submissions: We welcome feedback images, photographs, reviews, suggestions and comments from our guests and anyone using the Site. A guest of the Property or user of the Site (collectively, a “User”) may submit to us ideas, suggestions, drawings, graphics, innovations, concepts, recommendations, images, photographs, pictures, creative works, reviews, letters or other similar materials (collectively, “Submissions”). By submitting, uploading, posting, or sending Submissions to the Site you represent and warrant that: (i) said Submissions are not confidential, (ii) said Submissions are original to you and you are the rightful owner of any and all proprietary and intellectual property rights to them; (iii) that no other party has any rights to said Submissions, or (iv) you have the necessary licenses, rights, consents and permissions to use such Submissions and submit them to us or the Site for our use in accordance with these Terms, including but not limited to our promotional materials and in any manner related to Antrim Streamside, LLC’s business.  The User hereby assigns such Submissions to us without compensation (or the expectation of compensation) and agrees that we may disclose, reproduce, republish, modify, repost, distribute, display, perform, transmit, sell or otherwise use such Submissions for commercial or non-commercial purposes without compensation to the User (or the expectation of compensation). For any Submissions that cannot be legally assigned to us, the User hereby grants to us an unrestricted, perpetual, royalty free, irrevocable and worldwide license to reproduce, modify, distribute, display, perform, transmit, license, sell or otherwise use such Submissions for any and all commercial or non-commercial purposes with no compensation to the User. The User accepts full legal and moral responsibility for any and all legal claims that may be made by any third parties for our use of the Submissions. We are not responsible for maintaining, and may delete or destroy, any Submissions that you provide. You represent and warrant that your Submissions comply with these Terms, and you agree to keep all necessary supporting documentation, and to make such records available to us upon our request.

Right to Monitor and Editorial Control: We may (but have no obligation to) monitor or review any content submitted to the Site. We neither sponsor, endorse, control, nor bear responsibility for an such materials. However, we may disclose information or materials (including your Submissions) as necessary to satisfy any law, regulation or government request, or we may edit, refuse to post or remove any such content, in whole or in part, which violate these Terms or applicable law, or which in our sole discretion are objectionable. Using the Site may expose you to content of others that may be offensive, indecent or objectionable to you and we are not liable for such content.

Notices of Claimed Copyright Infringement: We respect the intellectual property rights of others, and require that Users of the Site do the same. We also maintain a policy that provides for the termination in appropriate circumstances of the Site’s use privileges of Users who are repeat infringers of intellectual property rights. If you believe that your work or any of the Site Content has been copied in a way that constitutes copyright infringement, please forward the following information to our Copyright Agent, designated as such pursuant to the Digital Millennium Copyright Act, 17 U.S.C. §512(c)(2) (the “DMCA”), named below: (i) your postal address, telephone number, and email address; (ii) a description of the copyrighted work or Site Content that you that you claim has been infringed; (iii) a description of where the alleged infringing material is located; (iii) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (iv) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyrighted interest; and (v) a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to on the copyright owners behalf.

4. General Terms
Prohibited Conduct: Users of this Site warrant and agree that they will not:

3. 3. • upload, transmit, post, email or otherwise make available to the Site any material in any format that (i) is false, inaccurate, misleading, fraudulent, unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, invasive of another person’s privacy or libelous, (ii) infringes any third party’s intellectual property or other proprietary rights or rights of publicity or privacy, or (iii) contains viruses, worms, Trojan horses, time bomb, corrupted files or any other software or programs designed to interrupt, interfere with, intercept, expropriate, destroy or limit the functionality of the Site or any computer software or hardware or equipment associated with the Site; (iv) contains images or other content that is pornographic, illegal, obscene, insulting, profane, objectionable or inappropriate;
      • alter, remove or falsify any attributions or other proprietary designations of origin or source of the Site or Site Content;
      • impersonate any person or entity, including, but not limited to, our owners, employees, officers, agents or affiliates or falsely state or otherwise misrepresent your affiliation with any person or entity;
      • attempt, through any means, to gain unauthorized access to the Site or another person’s information through the Site;
      • use any robot, scraper, spider or any other automatic device or manual process to monitor or copy the Site or any Site Content;
      • take any action that imposes an unreasonable or disproportionately large load on the Site;
      • take any action that creates liability for Us or causes Us to lose any of the services of our business partners, vendors or suppliers; or
      • take any action that would cause us to violate any applicable law, statute, ordinance or regulation or that is contrary to any of the terms herein.

Promotional Information: We may from time to time make information available on the Site regarding certain programs, offers, contests or promotions (the “Promotions”). Such Promotions are subject to different rules, policies and specific terms, conditions and restrictions disclosed in connection with such Promotions (“Promotion Terms and Conditions”) and are subject to being withdrawn or changed without prior notice. You are responsible to read any and all Promotion Terms and Conditions. We are not responsible for any typographical or other errors or omissions regarding prices, availability, or other information in connection with Promotions.

Links to Other Websites: The Site may contain links to third-party websites (“Linked Sites”) that you can access when visiting or using the Site, which are not owned or operated by us. We do not have any control over Linked Sites. YOU AGREE THAT OUR TOTAL LIABILITY FOR DAMAGES, REGARDLESS OF THE FORM OF ACTION, (WHETHER IN CONTRACT OR TORT, INCLUDING BUT NOT LIMITED TO NEGLIGENCE OR OTHERWISE) ARISING OUT OF THESE TERMS OF USE SHALL NOT EXCEED, IN THE AGGREGATE, THE GREATER OF (A) THE AMOUNT(S), IF ANY, PAID BY YOU TO ANTRIM STREAMSIDE, LLC TO ACCESS AND USE THE SITE, OR (B) TWO HUNDRED DOLLARS. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. ALL USERS OF THE SITE UNDERSTAND AND AGREE THAT (I)THE MUTUAL AGREEMENTS MADE IN THIS SECTION REFLECT A REASONABLE ALLOCATION OF RISK, AND (II) THE PARTIES HERETO WOULD NOT HAVE ENTERED INTO THESE TERMS OF USE WITHOUT THESE LIMITATIONS ON LIABILITY.

Liability Waiver: You acknowledge and agree that Antrim Streamside, LLC and the Protected Entities are not responsible for (i) any accidents, injuries or illness that may occur while visiting the Property and using its accommodations and its facilities, or (ii) the loss of personal belongings or valuables of our guests. By booking a reservation for an accommodation or an event, you acknowledge and agree that you are expressly assuming the risk of any harm arising from use of the Property by you, any persons traveling with you, or to others whom you may invite to use the Property.

Indemnification: You agree to indemnify and hold harmless, and release Antrim Streamside LLC, its subsidiaries and its officers, directors, shareholders, employees, agents, and representatives (and their respective successor and assigns) from and against any and all claims, damages, costs and expenses, including, but not limited to, reasonable attorney’s fees, arising from or related to your access, use, attempted use, inability to use or misuse of the Site or the Site Content or noncompliance with these Terms of Use. We will notify you of any claims and cooperate with you in defending the claim. You will reimburse us for reasonable expenses incurred in providing any cooperation or assistance. You will have full control and authority over the defense and settlement of any claim, except that: (i) any settlement requiring us to admit liability requires our prior written consent, and (ii) we may join in the defense with our own counsel at our own expense.

Compliance with Laws: In connection with the performance, access and use of the Site, each party agrees to comply with applicable laws, rules and regulations, including, but not limited to export, privacy and data protection laws and regulations. Each party represents that it is not named on any United States government denied-party list. Further, no User will access the Site in a United States embargoed country or in violation of any US export law or regulation. If necessary and in accordance with applicable law, we will cooperate with international, federal, state and local governmental authorities with respect to use of the Site.

Termination: We may terminate, change, suspend, restrict or discontinue any aspect of the site at any time if we believe you are in breach of these Terms or applicable law, or for any reason in our discretion, without notice or liability. These Terms will terminate commensurate with the discontinuance or termination of your Site use privileges. However, these Terms will nevertheless apply and be binding upon you and any persons you represent, jointly and severally, regarding your prior access to and use of the Site and Site Content, and anything connected with, relating to or arising therefrom.

Jurisdiction/Arbitration: These Terms of Use and the relationship between you and Antrim Streamside, LLC are governed by the laws of the United States and the State of New York without regards to its conflicts of laws provisions. You acknowledge and agree that any dispute, claim, or controversy arising out of or relating to any provision herein, including the determination of the scope or applicability of these Terms of Use to arbitrate, shall be determined by arbitration in Sullivan County, New York, unless the parties agree otherwise in writing. There is no judge or jury in arbitration and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow these Terms of Use. Arbitration shall be administered by the Judicial Arbitration Mediation Services (“JAMS”) pursuant to the JAMS Streamlined Arbitration Rules & Protocols effective July 1, 2014. The arbitration will be conducted by a single, neutral arbitrator. Arbitration may take place by phone or in the county. The award of the arbitrator shall be binding and final on all parties. Any dispute resolution proceeding arising out of or relating to the provisions herein, including arbitration, shall be conducted only on an individual basis and not in a class or representative action on behalf of others. The arbitration will be confidential and neither you nor Antrim Streamside, LLC may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award.  You understand and agree that, by accepting these Terms you and Antrim Streamside, LLC are each waiving the right to a trial by jury or to participate in a class action with respect to claims covered by this mandatory arbitration provision.

Severance: If any provision herein is found not be invalid or unenforceable, such provision shall be severed from the remainder of the provisions herein, which shall remain in full force and effect. No waiver of any breach or default of these Terms of Use shall be deemed to be a waiver of any preceding or subsequent breach or default.

Additional Consent: You may be required to agree to additional terms and conditions to access particular sections or functions of the Site.

Assignment/Transfer: We reserve the right, in our sole discretion, and without consent or notice, to transfer, assign, sublicense or pledge the Site or these Terms of Use, in whole or in part, to any person or entity. You may not assign, sublicense or otherwise transfer in any manner any of your rights or obligations hereunder.

Headings: The section headings used herein are for convenience only.

Entire Agreement: These Terms, as amended from time to time, including any other terms, conditions or policies to which they link or refer constitute the entire agreement between you and Antrim Streamside, LLC with respect to the access to and use of the Site and the Site Content.
